Islamic Nikah Requirements in Pakistan — Consent, Ijab-o-Qabool, Mahr, Wali, Witnesses and Khutba-e-Nikah

An Islamic Nikah is a contract, and like any contract it is valid when its conditions are satisfied and defective when they are not. The first step is to identify who the parties are and that both are marrying freely, what Haq Mehr is agreed and how it is split, whether the position followed requires a Wali and who will act, which witnesses will attend, and who will conduct and record the ceremony. Only then can the Nikah be arranged, the Nikah Nama completed and the registration handled in the correct order.

What Makes a Nikah Valid, and What Merely Makes It Traditional

The Conditions of a Valid Islamic Nikah

A Nikah is complete once these are met: both parties are identified and capable, both consent freely, Haq Mehr is agreed and stated, the Wali acts where the position followed requires one, competent witnesses are present, and the offer and the acceptance — Ijab-o-Qabool — take place in one sitting.

Everything else that surrounds a Pakistani wedding is custom. Custom is not wrong, and families are entitled to keep it. But it is worth knowing which part of the day carries the contract and which part carries the tradition, because only the first one has to be right.

What Is Not a Condition of Validity

  • Khutba-e-Nikah is a Sunnah of the occasion, not a condition. A Nikah without it is still valid.
  • Rukhsati is custom. The marriage exists from the Nikah, not from the rukhsati.
  • Walima is a Sunnah that follows the marriage; it does not create it.
  • A mosque, a hall, a particular date or a crowd — none of these is required.
  • Jahez is not part of the Islamic contract at all.

Couples are sometimes told that a Nikah is incomplete because one of the above has not happened. It is not.

The Elements of the Nikah, One by One

Ijab-o-Qabool: the Offer and the Acceptance

Ijab is the offer, Qabool the acceptance, and both must occur in the same sitting — the majlis. The words must be clear, they must refer to marriage, and they must be spoken or conveyed by the party or by an authorised Vakil.

Free Consent

Both parties must marry of their own free will. Consent obtained by force or by deception is not consent, and a marriage contracted in those circumstances is open to challenge. Where a free-will affidavit is required, it is the bride’s affidavit, attested by a licensed Justice of Peace or Notary Public.

Haq Mehr

Haq Mehr is the wife’s right. It is agreed between the parties, stated at the ceremony, and recorded in the Nikah Nama together with how much is prompt and how much deferred. It may be money, gold, property or anything else of value.

It is not a gift from the family, not a formality, and not something to be filled in casually at speed. It is recoverable, and the entry in the Nikah Nama is the evidence of what is owed.

The Wali

The schools do not take the same position here. On the Hanafi view an adult woman of sound mind may contract her own marriage, although questions of suitability may arise. On the Maliki, Shafi’i and Hanbali views the Wali is treated as a condition. Pakistani family courts have considered the question more than once, and the practice varies.

In practice, most families involve the Wali, and where he cannot attend he may appoint someone to act. Where a particular position is to be followed, say so at the outset.

Witnesses

For a Sunni Nikah, two adult sane Muslim male witnesses are required, or one male and two female witnesses. For a Shia Nikah, witnesses are not required in the same religious sense, but Pakistani registration practice still requires them for the legal documentation. Witnesses may be relatives of either party where they are legally competent, and their CNICs should be available on the day.

Khutba-e-Nikah and Dua

The Khutba is delivered by the Nikah Khawan before the contract is concluded, and dua follows. It gives the occasion its form and is strongly recommended, but as above, it is not a condition of validity.

The Nikah Ceremony, Step by Step

Order of Proceedings

The whole of it normally takes 20 to 25 minutes, including the paperwork.

  1. Identification of the parties and confirmation that both are marrying freely.
  2. Haq Mehr stated, with the prompt and deferred split confirmed.
  3. Wali and witnesses present, according to the position followed.
  4. Khutba-e-Nikah delivered.
  5. Ijab-o-Qabool — the offer put and accepted, in one sitting.
  6. Dua.
  7. Nikah Nama completed and signed by the parties, the Wali or Vakil and the witnesses.
  8. Registration through the licensed Nikah Registrar and the relevant local authority.

Who May Conduct the Nikah

An authorised Nikah Khawan, Imam, Qazi or licensed Nikah Registrar. A Nikah Khawan conducts the ceremony; a Nikah Registrar is the person through whom the marriage is registered, and the two are not always the same person. See Nikah Khawan and Imam services.

Documents, Requirements and Eligibility

What Is Needed on the Day

CNICs of the bride and groom, CNIC copies of the witnesses, and the CNIC of the Wali or Vakil where one acts. Photographs may be required by the registering office, and a divorce certificate or the death certificate of a previous spouse is needed where either party was previously married.

Minimum Legal Age for Marriage in Pakistan

The minimum legal age of marriage is 18 years for both male and female, including Islamabad Capital Territory, Punjab and Sindh, and age is verified against CNICs before the ceremony is arranged.

The Contract Is the Document That Lasts

The ceremony ends the same day. The Nikah Nama remains, and its columns carry legal effect — Haq Mehr and its split, any conditions agreed, and the delegation of the right of divorce to the wife. Going through it before anyone signs takes minutes. See the Nikah Nama and what each column means.

The Nikah with signing normally takes 20 to 25 minutes. Registration with the authorised Nikah Registrar normally takes one day, or 2 to 3 hours on an urgent basis where that facility is available.

Where the Schools Differ

On most of the elements the positions agree. Two are worth setting out plainly.

No. Jahez is custom and forms no part of the Islamic marriage contract. Haq Mehr, which the husband owes the wife, is the financial element of the contract.

What does Ijab-o-Qabool in one sitting mean?

The offer and the acceptance must occur in the same sitting, the majlis. Where a party cannot attend, an authorised Vakil may act in person on that party’s behalf so that the condition is satisfied.

What is the minimum legal age for marriage in Pakistan?

18 years for both male and female, including Islamabad Capital Territory, Punjab and Sindh.

Does the Nikah have to take place in a mosque?

No. A Nikah conducted at a home, hall, hotel or office with the required parties and witnesses present is as valid as one conducted in a mosque.

Is the Nikah complete without registration?

The Nikah is valid in Islam once its conditions are met. Registration is a separate statutory step that makes the marriage provable to Pakistani authorities, and it is compulsory under section 5 of the Muslim Family Laws Ordinance, 1961.
