Tajdeed-e-Nikah in Pakistan for Talaq, Ruju, Renewal of Nikah and Remarriage to the Same Husband
Senior Family Law Advocates for Talaq Notice, the Ninety-Day Period, Ruju, Tajdeed-e-Nikah & Section 7(6) Remarriage Across Pakistan
Tajdeed-e-Nikah Lawyers in Pakistan for Talaq Verification, Union Council Notice, Fresh Nikah and Halala Misconceptions
Our family law advocates establish whether a talaq has become effective at all before any question of renewal arises. The first step is to identify the exact words used and the date they were spoken, whether written notice was delivered to the Chairman of the relevant Union Council, when the ninety-day period began, and whether it expired or the talaq was revoked within it. Only then can ruju, a fresh Nikah, or the position under section 7(6) be assessed responsibly — and in a great many cases the answer is that the marriage never ended.

Why the Legal Position Matters Before Anyone Acts
Section 7 of the Muslim Family Laws Ordinance, 1961
This is the provision that decides most of these cases, and most people have never heard of it. Under section 7, a husband who pronounces talaq must give written notice to the Chairman of the relevant Union Council and supply a copy to the wife. The talaq does not take effect on the day it is spoken. It takes effect only when ninety days have passed from the day that notice reaches the Chairman — or, if the wife is pregnant, when the pregnancy ends, whichever is later. During that period an Arbitration Council is constituted to attempt reconciliation, and the talaq may be revoked.
The point that decides most cases: if no written notice was ever given to the Chairman, the ninety days never began to run. In the eyes of Pakistani law the talaq has not become effective, and the marriage subsists.
Three Pronouncements in One Sitting Are Not Three Talaqs
This is where the damage is usually done. A husband says the word three times in a single argument, and the family concludes that the marriage is irrevocably finished and that only halala can repair it.
Under the scheme of section 7 that conclusion does not follow. Each talaq becomes effective through its own notice and its own ninety-day period. Three words spoken in one breath do not pass through that process three times. Legally, they do not produce three effective talaqs.
Section 7(6): Remarriage to the Same Husband
Section 7(6) addresses the question directly. It provides that nothing shall prevent a wife whose marriage has been terminated by a talaq effective under that section from remarrying the same husband without an intervening marriage with a third person — unless that termination is for the third time so effective.
This wording was deliberate. Before 1961, where a talaq took any form other than talaq-e-ahsan, the couple could not remarry each other unless the wife first married another man and that marriage genuinely ended. The Ordinance was enacted to remove that bar, and the permission is written into the statute in positive terms.
Halala Has No Place in Pakistani Law, and None in the Sunnah
There is no institution of halala in the law of Pakistan. No statute requires it, no procedure provides for it, no authority registers it, and no court is empowered to order it. Section 7(6) does the opposite: it grants the right to remarry without any intervening marriage, and withholds that grant only where a talaq has become effective three separate times under section 7 — a threshold that the overwhelming majority of cases never reach.
So the sentence on which the entire halala trade rests — you said it three times, now halala is the only way back — rests on a premise that Pakistani law removed in 1961.
The religious objection is older and sharper still. The Sunan collections record the condemnation of the muhallil, the man who marries a woman in order to make her lawful to her former husband, together with the man for whom it is done. And on the view of the majority of jurists, a marriage contracted on a prior understanding that it will be dissolved is not a valid marriage at all, because that intention destroys the very thing a Nikah is. A contract entered into in order to be broken is not a contract.
Where money changes hands for such an arrangement, or where a woman is pressured into it, the matter has ceased to be a question of family law. It should be treated accordingly, and advice taken immediately.
The Process: Establishing Whether Anything Ended at All
Step-by-Step Approach to a Tajdeed-e-Nikah Question
Almost every case in this area turns on two narrow questions: what exactly was said, and whether written notice was ever given to the Chairman. The sequence below is how the position is established.
- Record what was actually said — the words used, the occasion, whether any condition was attached.
- Establish whether written notice was given to the Chairman of the Union Council, and on what date.
- Calculate the ninety-day period from the date notice was delivered, and check whether it expired or was revoked.
- Determine how many talaqs have become effective under section 7, counted separately.
- Identify the position to be followed on the religious questions, and refer them to a qualified mufti where required.
- Decide whether ruju, a fresh Nikah, or nothing at all is required.
- Register any fresh Nikah with the relevant authority so that the marriage remains provable.
Ruju During the Waiting Period: No New Nikah Is Required
Where a revocable talaq has been pronounced and the waiting period has not expired, the husband may take the wife back by ruju. No fresh Nikah, no fresh Mahr and no witnesses are required for that, although the couple would be well advised to record what has happened.
Where the period has expired and the marriage has ended, a fresh Nikah is required, with a fresh Mahr and the usual conditions of a valid contract. Even then — and this is the part most people do not expect — no intervening marriage is required, unless the third-time threshold in section 7(6) has actually been crossed.
What Has to Be Established, and What a Renewed Nikah Requires
Information Needed to Advise on a Renewal
Bring whatever exists in writing: any talaq notice, any acknowledgement from the Union Council, the original Nikah Nama, and the CNICs of both parties. Where nothing was written down, the dates and the exact wording still matter, and so does the identity of anyone who witnessed what was said.
A Renewed Nikah Still Has to Be Registered
If a fresh Nikah is contracted, it is a marriage like any other and section 5 of the same Ordinance applies to it. The prescribed Nikah Nama must be completed and the marriage reported to the licensed Nikah Registrar, and the marriage record is issued by the relevant Union Council, Town or Tehsil Municipal Administration, or Cantonment Board. NADRA does not issue that record; it verifies the registered particulars through its own system once they have been entered.
Couples routinely complete a renewal and never register it, and then find years later that they cannot prove the marriage when they need to. See Nikah registration in Pakistan and the Nikah Nama and its conditions.
The Schools Do Not All Say the Same Thing
On the questions that surround renewal — whether particular words amount to talaq at all, the effect of conditional or angry pronouncements, the requirement of a Wali, the number and capacity of witnesses — the Hanafi, Maliki, Shafi’i, Hanbali and Ja’fari positions are not identical. A ruling that is sound in one school may not be in another.
Nothing on this page is a fatwa. It sets out the legal position in Pakistan so that a family is not acting on a rumour. The religious ruling for a particular set of facts is for a qualified mufti, and it is worth putting the facts to one properly rather than accepting what was said in the heat of an argument.
Timelines and Service Areas
How Long the Position Takes to Establish
Where the papers exist, the legal position can usually be established in a single consultation. Where no notice was ever filed, that itself is often the answer. A fresh Nikah, where one is genuinely required, takes 20 to 25 minutes to solemnise, and registration normally takes one day.
Family Law Coverage Across Karachi, Lahore, Islamabad and Rawalpindi
Family matters are handled in Karachi, Lahore, Islamabad and Rawalpindi, and for overseas Pakistanis whose marriage is governed by Pakistani law. Because a talaq becomes effective through the Union Council for the area concerned, the relevant office is identified at the outset rather than assumed.

Common Claims and the Legal Position
The claims in the left-hand column are what families are routinely told. The right-hand column is what Pakistani law actually provides.
| What people are told | The position under Pakistani law |
|---|---|
| “He said it three times, the marriage is finished.” | Each talaq becomes effective separately under section 7. Three words in one sitting are not three effective talaqs. |
| “The talaq took effect the moment it was spoken.” | It takes effect ninety days after written notice reaches the Union Council Chairman, not before. |
| “Halala is now required before you can remarry.” | Section 7(6) permits remarriage to the same husband with no intervening marriage, unless the talaq has become effective three times. |
| “Renewing the Nikah counts as another talaq.” | On the Hanafi view, renewal of the contract is not itself a pronouncement of talaq. |
| “Nothing was written down, so it does not matter.” | The absence of written notice is usually the decisive fact, and it favours the marriage subsisting. |
If your situation appears in the left-hand column, the position is very likely better than you have been told. It should be checked before anything irreversible is done.
Ruju, Fresh Nikah, or Nothing at All
What is required depends entirely on where the matter sits in the section 7 process. The table below sets out the three possibilities.
| Situation | Is the marriage over? | What is required to resume |
|---|---|---|
| Words spoken, no notice ever filed | No | Nothing. The marriage subsists. |
| Notice filed, ninety days not expired | Not yet | Ruju. No fresh Nikah or Mahr needed. |
| Ninety days expired, first or second talaq | Yes | Fresh Nikah with fresh Mahr. No intervening marriage. |
| Third talaq effective under section 7 | Yes | The section 7(6) permission does not extend here. Take legal and religious advice on the facts. |
Note how narrow the last row is. It requires three separate talaqs, each with its own notice and its own ninety-day period — not three words in one argument.

Tajdeed-e-Nikah — Frequently Asked Questions
What does Tajdeed-e-Nikah mean?
Tajdeed-e-Nikah means the renewal of an existing marriage contract, where the same husband and wife enter into the Nikah a second time. It is not a divorce and does not by itself end the marriage.
Does saying talaq three times end a marriage in Pakistan?
No. Under section 7 of the Muslim Family Laws Ordinance, 1961 each talaq becomes effective only ninety days after written notice reaches the Union Council Chairman. Three words spoken in one sitting do not produce three effective talaqs.
Is halala required in Pakistan?
No. There is no institution of halala in Pakistani law. Section 7(6) expressly permits a wife to remarry the same husband without any intervening marriage, unless the talaq has become effective three separate times under section 7.
What happens if no talaq notice was ever sent to the Union Council?
The ninety-day period never began to run, so the talaq has not become effective and the marriage subsists in law. This is the decisive fact in a large proportion of cases.
Is a new Nikah needed to take a wife back during the waiting period?
No. Where a revocable talaq has been pronounced and the waiting period has not expired, the husband may take the wife back by ruju, without a fresh Nikah, fresh Mahr or witnesses.
What is needed if the waiting period has already expired?
A fresh Nikah is required, with a fresh Mahr and the usual conditions of a valid contract. No intervening marriage is required unless the third-time threshold in section 7(6) has actually been crossed.
Does renewing the Nikah count as another talaq?
On the Hanafi view, renewal of the marriage contract is not itself a pronouncement of talaq. Positions differ between the schools, and the ruling for particular facts should be taken from a qualified mufti.
Does a renewed Nikah have to be registered?
Yes. A fresh Nikah is a marriage like any other, so section 5 of the Ordinance applies. The Nikah Nama must be completed and the marriage reported to the licensed Nikah Registrar, with the record issued by the Union Council, TMA or Cantonment Board.
What should someone do if they are being pressured into halala?
Take legal advice before anything happens. Where money changes hands for such an arrangement, or where a woman is pressured into it, the matter has gone beyond family law and should be treated accordingly.
Is this page a fatwa?
No. It sets out the legal position in Pakistan so that families are not acting on a rumour. The religious ruling for a particular set of facts is a matter for a qualified mufti.
Do you advise on these matters outside Karachi?
Yes. Family matters are handled in Karachi, Lahore, Islamabad and Rawalpindi, and for overseas Pakistanis whose marriage is governed by Pakistani law.
Our Offices and Service Areas
If someone has told you that your marriage is over, or that halala is required, two questions usually settle the matter: what exactly was said, and whether written notice was ever given to the Chairman. Both take a short conversation to establish, and both are worth establishing before anyone takes an irreversible step.
